Candidate committee sued in Stanly by polling company

A Wyoming-based political polling company has sued in Stanly County against a committee representing Republican gubernatorial candidate Mark Robinson.

Filed Oct. 28, the lawsuit alleges the Friends of Mark Robinson, a “property registered North Carolina political candidate committee,” contracted with Vox Insights, LLC, based in Sheridan County, Wyoming, to “furnish certain polling results…in exchange for monetary compensation.”

The suit mentions Conrad Pogorzelski III as a “general consultant” for the committee, as having signed the contract.

Vox Insights invoiced the committee for $114,000 on Sept. 28 and has not received payment. The suit alleges the committee “does not intend to pay (Vox) prior to Election Day,” and adds the committee “is not capitalized to pay its debts.”

The company is suing for breach of contract, asking for $25,000 in damages and $25,000 additional for unjust enrichment, meaning the services rendered “had some value to the defendant.”

Vox’s lawsuit is also looking for a temporary restraining order and injunction against Robinson for NC.

Austin Backus and Justin G. May of the law firm of Michael Best & Friedrich, LLP, filed the lawsuit.

A spokesperson for Robinson issued the following response to WCNC Channel 36: “This lawsuit is completely baseless. The campaign has resolved all invoices for all previous work from this company, and does not owe them one penny. The campaign has not seen any work product from this company on this so-called project, and the work they are alleging was agreed to by a consultant — without Lt. Gov. Robinson’s knowledge or consent — that is no longer with the campaign and had no authority to authorize it. This matter is clearly being pushed by political grifters that are just trying to extort more money from the campaign, and we’re confident that we’ll be successful in court and these bad actors will be exposed.”
