Thursday, October 9, 2008 — The zoning request for Berry Hill Drive was discussed Monday evening by Norwood Town Council and Robbie Cohen of Cohen Construction.
The request is to change J&J;’s Marina and adjoining property from residential to conditional zoning, which will allow Progress Energy, North Carolina Department of Transportation (NCDOT) and the town to place conditions on the property. Plans are to construct Lake Tillery Condominiums, a restaurant and a new marina.
A letter from Bank of Stanly was submitted. Even though it was not a letter of credit the board requested, it was a very strong letter, according to Town Administrator Dwight Smith.
Cohen relayed to council members that NCDOT, Progress Energy and Bank of Stanly would rather issue their permits and letters once the drawings are complete and the rezoning request is passed.
“We have obtained and submitted a letter from the state DOT stating that they will give us access, but until further plans are given, they aren’t sure how they will do that,” he said.
Also, drawings must be in place before a letter of credit can be given and with the amount of approvals Progress Energy must go through, they would rather have rezoning in place beforehand.
No decision was made, however, the council instructed Smith to have their attorney draft a letter that includes all the conditions that have been set forth thus far before voting on the zoning request.
Councilwoman Beverly Johnson requested another condition that will prevent the property from becoming weekly rental space.
Cohen said he would rather not have the condition but it wouldn’t stop the project.
“It would limit buyers but it also would appeal to others as well,” Cohen said.
Berry Hill resident Sam Songer spoke to board members regarding the zoning request, stating if the board voted in favor of the request, they would be taking his rights away from him.
In response, Cohen said everyone who moved on Berry Hill Drive knew a marina, a restaurant and a campground had been apart of the community earlier in its existence.
“We aren’t changing anything,” Cohen said.
“We are just improving it.
“It’s a conditional use permit. All we can do is what we are submitting.”
Action was deferred until a special meeting on Oct. 20. The meeting is open to the public and will begin at 7 p.m. at Norwood Town Hall.
